Mobile Mesh Games, LLC (“Mobile Mesh” or “we” or “us”) owns, operates and provides the sites, software, applications, content, products and services (collectively, the “Services”), which may be branded as Mobile Mesh, Arcade Challenge or another brand owned or licensed by Mobile Mesh.


1. Information We Collect

You provide personally identifiable information when you register for an account, enter into a transaction with us, use or access software or applications, post or transmit content (including any text, graphic, audio, video, or other content), or respond or subscribe to surveys, newsletters or mailing lists.

When you access or use the Services, we may send one or more cookies – small files – to your computer or other device. We may be able to uniquely identify your browser or device with such cookies. We use session cookies and persistent cookies. Session cookies provide information to us while your browser is open. Persistent cookies provide information to us after you close your browser and later re-open it. If you disable cookies in your browser, some features of the Services may not function.

We may also record certain information that your device sends whenever you access or use the Services. 2. How We Use Collected Information

We use collected information, and share collected information with our affiliates, other businesses, suppliers, vendors, licensors, and agents, in order to operate, maintain and provide the features and functionality of the Services.   • alert you to new features and functionality, or to products and services offered by us or by third parties;
  • remember information so that you will not need to re-enter it;

  • monitor Services usage; and

In the event that we are involved in a merger, acquisition, sale, bankruptcy, insolvency, reorganization, receivership, assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, or a change of control, there may be a disclosure of your personally identifiable information to another entity related to such event, and we may not control how the information is treated, transferred, or used by that entity.

3. Your Controls and Choices

We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information. Your controls and choices include the following:

  • you may correct, update, and delete or your information as described in the “Deletion and Correction of Collected Information” section below;
  • you may change your choices for subscriptions, newsletters, and alerts as described in the applicable subscription, newsletter, or alert;
  • if applicable, you may request a list of all third parties to which we have disclosed your personal information during the preceding year for direct marketing purposes and a disclosure of the shared information, as described in the “Your California Privacy Rights” section below; and
  • if applicable, you may request the removal of content you posted to the Services, as described in the “Your California Privacy Rights” section below.

You may, of course, decline to submit personally identifiable information to Mobile Mesh, in which case Mobile Mesh may not be able to provide certain services to you.

We reserve the right to take reasonable steps (such as requesting your password) to verify your identify before granting you access to the Services or making corrections or deletions. You are responsible for maintaining the secrecy of your password and account information at all times.

4. Deletion and Correction of Collected Information

At your request, we will delete from our active databases your personally identifiable information collected by us. We may retain such information, however, to the extent required by law or if copies are kept in archival backups.

At your request, we will also use reasonable efforts to correct your personally identifiable information contained in our active databases.

5. Security and Integrity of Collected Information

We use commercially reasonable safeguards to preserve the integrity and security of the collected information. We do not, however, warrant the integrity and security of the collected information.

6. Children’s Personally Identifiable Information and Kid Services

We recognize the need to provide further privacy protections with respect to personal information we may collect from children under age 13 from the Services. Some of the Services contain a screen where a user must enter his or her age (also known as age-gating), so that the Services that include age-gating are not available for use by children under age 13. We do not knowingly collect, maintain, or disclose personal information from children under age 13 in connection with the Services that include age-gating.

We may, however, offer certain of the Services with limited functionality for children under age 13 (the “Kid Services”). Kid Services may include mobile applications.

We may use personal information, including without limitation, a cookie, an IP address, a processor or device serial number, a unique device identifier or another identifier (collectively known as “Persistent Identifiers”), in order to provide for the following operations:

  • maintaining or analyzing the functioning of the Kid Services;
  • performing network communications;
  • authenticating users of, or personalizing content on, the Kid Services;
  • serving contextual ads on the Kid Services or capping the frequency of advertising on the Kid Services;
  • protecting the security or integrity of a user of the Kid Services;
  • ensuring legal or regulatory compliance; and
  • for other internal operations of the Kid Services.

We may retain third parties to assist us in providing for the above-listed operations. We do not, however, use Persistent Identifiers or knowingly allow others to use Persistent Identifiers, to contact a specific individual, including through behavioral advertising, to amass a profile on a specific individual, or for any other purpose. We do not knowingly collect, maintain or disclose any other personal information from children under age 13.

If you are under age 13, or a parent or guardian of someone under age 13, do not enter any other personally identifiable information about anyone under age 13 when using or accessing the Services. If you are a parent or guardian who has discovered that your child under age 13 has submitted any personally identifiable information to us without your permission or consent, we will make reasonable efforts to remove the information from our database, at your written request. To request the removal of your child’s information, please contact us as described in the “How to Contact Us” section below and include in your message your child’s name and the information your child submitted.

7. Links to Other Sites

We may offer links to other sites from the Services. We have no control over these external sites or their content and are not responsible for any actions that they may take or any information they may collect. You may arrive at such sites through clicking on an advertisement, as part of a co-branding arrangement, or simply by selecting a link on another website. You should be aware that the Privacy Policy does not apply to your use of these sites. If you provide any information to such sites, different rules regarding the collection and use of your information and other information may apply. Before using these linked sites, you may wish to review their privacy policies to understand how they treat privacy, security, data collection, disclosure, distribution, and use.

8. Your California Privacy Rights

Residents of the State of California, under the California Civil Code, have the right to request from certain companies conducting business in California a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes and a disclosure of the shared information. To make such a request, contact us as described in the “How to Contact Us” section below.

Please note that some web browsers and devices permit you to broadcast a preference to websites and online services that they “do not track” your online activities. At this time, we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received.

If you are a California resident, you are under age 18, and you have registered an account for the Services, you may request the removal of the content you posted to the Services. To request such removal, contact us as described in the “How to Contact Us” section below. Please include with your request your username and a clear statement that you would like us to remove the content you posted to the Services. We may ask, and you will provide us with, additional details in order to remove the content you posted to the Services.

Your request does not ensure the complete or comprehensive removal of the content you posted to the Services. We are not required to remove content you posted to the Services if you fail to follow our instructions related to such removal or if:

  • we are required by law to maintain the content;
  • a third party stored, posted, republished, or reposted the content; or
  • we anonymize the content so that you cannot be individually identified by it.

9. Third Party Advertising

We may use third-party advertising service providers to display ads in the Services. Those providers may use their own cookies and other technologies to collect information about your interaction with the Services. In addition, we may share with those providers technical or aggregate information about your interaction with the Services.

Those providers may use the information they obtain, sometimes in conjunction with similar information gathered through other websites, to deliver ads in the Services and on other websites or services that participate in the providers’ advertising networks. Those ads may be intended to match the perceived interests of consumers. Those providers may also use the information they obtain to measure and research an advertisement’s effectiveness, or for other purposes.

The use and collection of information by third party advertising service providers is governed by such party’s privacy policy, not the Privacy Policy. 10. Governing Law; Jurisdiction

The Services are hosted in the United States. If you are user accessing the Services from outside the United States or any other region with laws or regulations governing personal data collection, use and disclosure that differ from the United States laws, please be advised that through your continued use of the Services, which are governed by U.S. law, you are transferring personal information to the United States and you consent to that transfer.

The laws of the State of Wisconsin and applicable United States law govern all matters arising out of or relating to the Privacy Policy and the Services, including, without limitation, interpretation, construction, performance, and enforcement, without giving effect to such state’s conflicts of law principles or rules of construction concerning the drafter hereof. You hereby irrevocably and unconditionally submit to the jurisdiction of the federal and state courts located in Dane County, Wisconsin for the purpose of any suit, action, or other proceeding arising out of or based upon the Privacy Policy, your access to or your use of the Services, which courts are the exclusive forum for any such suit, action, or other proceeding.
